And then, most of the emerging modifications of spice are “variations on the theme” of substances that have been deciphered earlier. In addition, the law weakened the bonds of judicial casuistry at the hands of medical experts and law enforcement officers. Now it is not necessary to write down the name of the substance “before the comma”, reflecting the long chain of its formula. If this formula basically coincides with the already known basic one, it is enough to indicate: “Derived from such and such”. What counts: "name" is named.
A doctor does not substitute?
The most compelling reason for accusing spice smokers is the conclusion of the narcologist about the adequacy of the condition of the person who was taken for examination. The specialist does it based on reactions, behavior. But the question is: is it dangerous for drivers that so much depends on the “human factor”?
It is impossible to rule out cases of “special relations” between narcologists and traffic police officers, who would like to “smudge” someone. However, the probability of betraying a physician’s debt is practically zero, I am sure Alexey Smirnov. Look, in the body of any person you can find signs of substances that can be attributed to psychoactive. These are traces of the constant upbringing of coffee, tea, and the intake of many medicines. However, no one had heard the expert accuse someone of using drugs if he had an absolutely adequate person.
Reverse option. Nothing can replace the opinion of a specialist when in front of him is a citizen who, according to laboratory analysis in his life, has not used drugs, but because of physical fatigue and psychological overload, he has come to a condition that does not allow driving. It is difficult for the uninitiated to imagine, but my own practice and the experience of my colleagues give me the right to say that a driver with a weakened body may fall into “other toxic intoxication” (this is one of the acceptable formulations in a medical certificate), even imagine if you take any generally available medicine. And do not eat any foods with poppy seeds - then morphine can be found in the urine, and do not prove that you are not a “drug addict”. In developed countries, before issuing a driver’s license, a candidate for signing up is introduced to a list of what the driver should not use, and so are items with poppy seeds.
What will happen in the "driver" drug law
The detection thresholds of the substances we are talking about, of course, need to be clarified. Wait a short time, suggested Alexei Smirnov. As soon as political squabbles about the permissible alcohol content for drivers have settled down (finally the light shimmered in the tunnel), the Ministry of Health order on a new survey procedure will be issued relatively quickly. It will spell out the grounds for the conclusion of "other toxic intoxication."
Under this interpretation, I am sure Aleksey Smirnov, there will be persons who, during the examination, the narcologist identify several clinical signs of intoxication, and one or more substances (or their metabolites) are found in the urine sample, which, although not considered drug drugs and psychotropic substances, able to cause "other toxic intoxication." They will also include legal “nonsense” (while legal), including smoking mixes. We will deal with nasva too: for nicotine and cotinine (an alkaloid found in tobacco; a metabolite of nicotine) that which is more terrible is not hidden. At the Moscow Scientific and Practical Center for Narcology, the development of the methodology is nearing completion. Alexey Smirnov promised: we will create conditions for all this rubbish that are not compatible with its existence in Russia.

We love to be horrified by the vagaries of democracy in the West, the horror of which the police tell about the brutality of the police, but with our law enforcement authorities there are no less horrors. Of course, the thief should be in prison, and the offender should be punished. But why lawmakers do not hear lawyers and doctors who claim that there is a difference between traces of drugs (or traces of alcohol) and intoxication ? De jure today in Russia, a person who used an antitussive or pain reliever (or even a bun with poppy seeds) the day before can be considered a drug addict and a malicious violator, and in the event of an accident, the driver has a chance to get 9 years in prison!

It is not uncommon for cases to appeal against the conclusions of doctors. Everyone is mistaken, but not all drivers have the opportunity to fight for their rights (and not everyone knows how).
In order to exclude judicial errors, civilized countries in 1971 supplemented the UNECE Convention with an agreement (Russia has been a member of it since 1948).
Clause 7 obliges the contracting parties to “provide for special provisions in national law regarding driving while intoxicated, as well as the permissible level of alcohol in the driver’s blood and, if necessary, in exhaled air”. What acceptable alcohol level is accepted in “this country”, I think, it’s not worth reminding.
