… Daily on the website of the State Automobile Inspection of Russia accident reports are published. For example, on March 28, 312 accidents occurred, 33 people died (a normal day, it can be worse). The worst accident of the day is in the Vologda Oblast: a scorcher on the Lada overtook a truck along an oncoming lane, cut it, and he drove into the bus. As a result, six were killed, 33 people were hospitalized. The culprit of the accident was sober and turned out to be a police major. Apparently, he got used to the fact that he was allowed to break the rules. But what’s interesting: there are not so many accidents with grave consequences caused by drunk drivers. Most often in the reports appears the phrase: "I did not manage the management." Or: "Due to poor road conditions." Statistics confirm this: in the first two months of 2013, only 4.8% of traffic accidents involving drunk drivers took place. For comparison: 27.5% of accidents occurred due to poor road conditions. But our officials and deputies with uncontrollable energy continue to fight precisely with those who got behind the wheel of a bogey!
In March, the State Duma in the first reading almost unanimously adopted the so-called "Spring Law", proposing to introduce a new article in the Criminal Code of the Russian Federation - 264.1. It says that drunk drivers who were previously deprived of a driver’s license for a similar offense will be punished with a fine of 200 thousand rubles, either by compulsory labor for a period of 480 hours, or by forced labor up to 2 years, or by arrest for 6 months. In addition, deputy Yarovaya suggested sharply increasing the punishment for drunk drivers who became responsible for road accidents with victims. At first, she demanded that they be imprisoned for 15 years, but this proposal was criticized by the Supreme Court and the document was slightly changed. Now they offer a drunk driver for an accident with one deceased punished with imprisonment from 2 to 7 years (now just up to 7 years) with a 3-year deprivation of a driver’s license; if there are more than two victims, the term of imprisonment is from 4 to 9 years (now up to 9 years), rights - 3 years.
Waiting for changes and the 12th chapter of the Administrative Code of the Russian Federation. Those who are drunk at the wheel for the first time are offered not only to deprive of their rights for one and a half to two years according to the current legislation, but also to be fined 30 thousand rubles. The same penalties are also threatening for refusing a medical examination. For transferring control to a drunk driver, they will be punished with excommunication from the steering wheel for one and a half to two years and fined 10 thousand.
In a word, the authorities very seriously took up the fans to drive after a drunk. Actually, the vast majority of drivers are also for not being drunk on the roads! But only deputies consider that it is possible to struggle only with severe punishments.
Moreover, the law is adopted so hastily that in it even a layman will see a lot of inconsistencies. If they accept him, it is more profitable for a driver weighed down by “pounds” to flee the scene of an accident - then, having arrived in the morning, he will receive a shorter term. You can also specifically hit your head (be sure to bleed!) And pretend that he lost consciousness. In this case, the doctors will take care of the injured and his condition will be determined by a blood test, and according to the instructions of the Ministry of Health, a driver injured in a traffic accident is considered drunk only if more than 0.5 ppm of alcohol is found in his blood. Such a norm is established in accordance with the requirements of the World Health Organization and the International Convention on Road Traffic.
