The first bill was introduced by deputies of the Volgograd Regional Duma, passed the first reading in December last year and during that time has changed a lot. The current option provides for a delay for payment of compulsory motor third-party liability insurance a penalty to the victim, depending on the amount of insurance compensation, and for the delay of a motivated refusal to pay - a fixed fine of 500, 5000 or even 25, 000 rubles. (depending on the delay period). True, the period allotted by law for payment or a reasoned refusal may increase from 15 to 30 days.
The second bill, which provides for linking the “bonus-malus” coefficient (more about it in ЗР, 2005, No. 3) to the insurance history of the driver, and not the car, as in the current OSAGO law, was proposed by State Duma deputy Alexei Sigutkin. Insurers consider this to be impossible so far - there is no single all-Russian client base by which you can track the client’s insurance history. Without such a base, the application of a system of discounts and allowances is realistic only within each individual insurance company. This means that car owners who traveled for a year without an accident, in order not to lose the legitimate “discount”, are forced to conclude an insurance contract with the same company, even if they are not satisfied with its service.
The first bill has good chances to become law this year, while the second one does not have too many.
At the same time, the Ministry of Finance of Russia, on behalf of the government, is preparing a long-promised draft amendment to the law on compulsory motor third-party liability insurance, providing for a simplified procedure for processing documents after an accident (without leaving the traffic police if the health of the participants in the incident is not harmed) and direct settlement of losses.
All this is included in the concept of Europrotocol, which has long been successfully operating in Europe and other countries of the world. But - not with us. The problem that insurers are afraid of when introducing such rules is the heyday of all types of fraud, especially when you consider that there is no single customer base yet. Even in quite prosperous little Israel, the total losses from OSAGO fraud for the year reach $ 400 million. What can we say about Russia!
Before introducing the Europrotocol, the Ministry of Finance proposes to organize the work of emergency commissioners, who should not only be able to correctly draw up an accident diagram, but also tentatively assess the amount of damage. We still have a single service of emergency commissioners working in only a few cities, and even that, one might say, on a voluntary basis. If everything goes as the authors of the project plan, the new system can work in Russia from July 1, 2007.
